Briar Associates is an Energy and Environmental Engineering Consultancy that was formed in 1989. Since its inception, Briar Associates has assisted a diverse range of clients save millions of pounds in energy costs, comply with legislation, reduce their carbon footprint and understand their energy use and environmental impact far better. Providing these services inevitably involves the collection and analysis of data. Very little of this data is classified as “personal data” under European Union (EU) law as it is predominantly information relating to business energy consumption, site facilities, etc and does not relate directly to an individual. The success of our business has been through working closely with clients, developing strong working relationships and delivering a very high quality of service. Maintaining business contact information is an essential part of this. This privacy notice provides the information we are required to give in relation to the processing of personal data under EU law.

What Information Do We Collect and Why?

Briar Associates processes information to support the services we provide. To advise on energy consumption we collect and analyse energy usage data; to make recommendations on energy efficiency improvements we look at and record energy consumption, building fabric, facilities, working patterns and policy. These are examples of where processing data is critical to the service we provide but where the core data being processed does not relate to an individual and so is not classified as “Personal Data”. However, in the course of delivering these services we will record the name of key contacts who place the orders and the details of additional contacts as appropriate such as Site Managers, Accounts Staff, Purchasing Staff, etc. The purpose of this processing is to enable us to provide an effective, tailored and personalised service to all of our clients.
Similarly Briar Associates records the contact details of key suppliers and service providers that enable us to run our business operations.
Briar Associates also processes personal information of its employees in order for it to fulfil its contractual obligations.
In addition to existing client key contact data we do occasionally also use accredited providers, such as Dun & Bradstreet, to help us to identify contact information for legitimate business prospects.
Briar Associates does not collect any information in relation to an individual’s race or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, health, sex life or sexual orientation, genetic or biometric data.

Who do we share information with?

Briar Associates only shares information where this is necessary for either the provision of services to a client or for our own business operations.
1. Clients – whilst providing services it may be necessary to provide information, including personal data, that relates directly to the provision of a commissioned service.
2. Service providers – when arranging services such as meter installations, utility contracts, 3rd party inspections, planning and/or connection applications, etc, it may be necessary to share certain information including key business contact data with the provider for the sole purpose of fulfilling the specific service at hand.
3. Sub-contractors – when outsourcing certain business functions such as IT support and Business Accounting, it may be necessary to share information sets that include personal data.
4. Legal or Regulatory bodies – when required to do so by law or the terms of the service being provided it may be necessary to share data, including personal information, that is affected by the data request.

Data Retention

Personal data is stored for varying lengths depending on the nature and purpose for which it was collected. We store personal data in line with any applicable statutory minimum periods, and then review it periodically (usually annually) to ensure it is still necessary to be retained for the purpose for which it was collected.

Grounds of Processing

In technical legal terms we process personal data under two main grounds which are “legitimate interests” and “contract”. Briar Associates’ legitimate business interest is the provision of Energy and Environmental Engineering consultancy services. The purpose of this processing is to enable businesses to manage their energy costs, meet compliance and regulatory obligations and better understand their energy consumption, energy costs and environmental impact. Some processing is under the “contract” legal basis and is where contracted service provision could not be fulfilled without the processing of personal data.

Data Subject Rights

You have the right to request from us confirmation of whether we are processing your personal data, and if so access to that information. To do this, please e-mail info@briarassociates.co.uk. All enquiries will be dealt with promptly although the nature of the enquiry may affect how long it takes to respond. In all cases enquiries will be responded to within 28 days from receipt.
If any of your personal data is inaccurate you have a right to request rectification. We are very keen to ensure the data we hold is accurate and up to date. Please contact info@briarassociates.co.uk should you identify that any information we hold to be incorrect.
If we are processing your information on the basis of “Legitimate Interests” you have the right to object to our processing and/or request it is deleted or restricted. In considering our response we undertake to ensure your interests, fundamental rights and freedoms are properly balanced against our legitimate interests. Handling our Clients’ data

Sometimes our customers provide us with their business data, such as their customer or supplier data – which may contain personal data – in order for us to provide them a service. In these instances we are the processor of any personal data contained in their data. Different parts of the GDPR apply when we act as a processor and we take these obligations very seriously. We handle the data our customers provide us in strict accordance with the agreement formed with the Data Controller – and only for the purposes of the agreement.

We strive for continuous improvement in our services, processes and protecting data subject rights. We will therefore update this privacy notice from time to time. Therefore, we advise you to check this notice on a regular basis, or if requested we will send it to you on a regular basis.
